Understanding the Available Options

Guardianship generally concerns personal care and decision-making. Conservatorship generally concerns property and financial affairs. Whether either arrangement is appropriate, and how much authority is needed, depends on the person's circumstances and the applicable law.

We review existing powers of attorney and estate-planning documents, trusts, support arrangements, and other alternatives before recommending court action. The objective is to address a demonstrated need while preserving independence wherever possible.

Adult Guardianship and Conservatorship

We assist with petitions, responses, hearings, and disputes involving adults affected by illness, injury, disability, or diminished capacity. Our work may include evaluating medical information, preparing witnesses, addressing disagreements over a proposed fiduciary, and considering whether limited authority or another arrangement can meet the person's needs.

Representation in Contested Proceedings

Family members may disagree about whether an appointment is necessary, who should serve, or how a person's money and care are being managed. We represent petitioners, respondents, family members, and appointed fiduciaries as appropriate to the engagement. We also assess requests to modify or terminate existing arrangements and concerns about a fiduciary's performance.

Matters Involving Minors

We advise families when a minor needs a court-appointed guardian or assistance managing an inheritance, settlement, or other property. We explain the proposed arrangement, the court process, and the responsibilities that may continue after an appointment.

Support After Appointment

An appointment is often the beginning of ongoing responsibilities. We assist guardians and conservators with questions about authority, required reports and accountings, proposed transactions, changes in circumstances, and requests for court approval.

Urgent Situations

If there is an immediate concern involving safety, care, or financial exploitation, tell us when you contact the office. We can assess whether expedited court relief may be available. Emergency services should be contacted directly when immediate physical safety is at risk.

Discuss a Guardianship or Conservatorship Matter

Call (314) 227-1014 or contact our office. If available, bring existing court orders, powers of attorney, relevant medical information, and a summary of the decisions or financial issues causing concern.

Experience in Contested Capacity Proceedings

Our representative matters include a guardianship case in which James represented the respondent at a jury trial. The jury found the client had capacity, and the guardianship request was defeated. We also represent petitioners and appointed fiduciaries in appropriate matters. Review representative case results.
